Stalking Protective Order Attorneys
No-contact orders are not unusual in cases of divorce, especially when there are accusations of domestic violence. These orders can have extremely serious consequences both personally and professionally. Whether you are seeking a no-contact order or your spouse is seeking such an order against you, the stalking protective order attorneys at Manassa Law P.C., have the experience to guide you. With offices in Barrington, Crystal Lake, St. Charles, Oakbrook Terrace and Deerfield, we serve clients throughout the Chicago metropolitan area of Illinois.
If You Are Seeking A Protection Order
If you are a victim of harassment, threats, stalking or physical violence, our lawyers can help you obtain an order for protection. This order may contain many types of injunctions. For example, it may require the other party to stay 500 feet away from your home and place of employment. It may also prohibit the party from calling you at home or work, contacting you through email, or posting about you on social networking sites. If the other party violates the order, he or she can be arrested and charged with a crime.
You can obtain a temporary protection order based on your testimony alone. This order will typically remain in effect for 21 days, at which time the court will schedule a hearing at which both parties' testimony will be heard. At that hearing, the court will decide whether to issue a plenary order of protection, which can last up to two years.
If Someone Is Seeking A Protection Order Against You
Protection orders can be used as a sword as well as a shield. It is not unusual for a vengeful spouse to seek a no-contact order in order to gain the upper hand in a divorce dispute.
If your spouse obtains a temporary protection order against you, it is important to seek legal representation for the protective order hearing. A protection order can result in removal from your home. It could also affect your child custody and visitation rights, your employment, and your reputation. Although the emergency (initial) order is typically valid for 21 days, the statute allows for an earlier hearing when the proper notice is filed.
