Motions To Vacate
You can seek a motion to vacate a judge's decision if you have a strong basis. Examples include a misapplication of the law as to the facts of your case or new information that was not known at the time of the ruling. There are two types of motions to vacate:
• Motions to vacate within 30 days of a judge's ruling.
• Motions to vacate more than 30 days after a judge's ruling.
If you wait longer than 30 days, you have to show due diligence as to why you waited so long to file the motion. Motions to vacate are never easy to obtain, but are much more difficult if filed after 30 days.
Motions To Reconsider
A motion to reconsider is a motion to see if the judge has changed his or her mind. Motions to reconsider are filed before an appeal. Judges will reconsider rulings at times when shown controlling case law.
Appeals
If you think the judge made a legal mistake or misused his or her discretion, you can file an appeal to have the case reviewed by a higher court. You will not be able to introduce new evidence at an appeal. The higher court will consider the transcript and evidence of your trial, along with briefs filed by your attorneys.
