A Postnup Works Much Like A Prenup, But It Is Created After A Marriage
A prenuptial agreement can provide peace of mind and guard against future legal fees. In the same way, a postnuptial agreement can document after marriage two spouses' understandings about ownership of property or other critical issues. Postnuptial agreements (postnups) are relatively rare, but there are a number of circumstances where they make very good sense.
Examples of reasons to consider creating a postnuptial agreement include:
• If your marriage is in trouble and you would like to take material matters out of the mix as you focus on personal aspects of your relationship
• As a tool for reconciliation while a nearly broken marriage is under repair (perhaps after an affair, an arrest, recovery from substance abuse or recovery from a gambling addiction)
• If you or your spouse is about to start a business and you want to keep each other's financial affairs separate to protect both your family finances and your business
• To revise a prenup, for any number of reasons
